GULF STREAM, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — All charges have been dropped against the Delray Beach woman who suffered a medical event in the area of 2401 North Ocean Boulevard in early January and plowed into a herd of bicyclists out for an early morning ride.
As BocaNewsNow.com was first to report on February 14th: “Betty Ann Ruiz of Atlantic Avenue in Delray Beach was driving southbound on A1A around 7:05 a.m. when she blacked out, swerving into a pack of bicyclists heading northbound. Seven cyclists were hit. FHP says they were all wearing helmets. Two were immediately transported to Delray Medical Center in critical condition. Several others also required medical attention.”
Ruiz was charged with “failure to drive in a single lane,” “unknowingly operating a vehicle while license suspended or revoked,” and “failure to provide proof of insurance.”
The investigating trooper for Florida Highway Patrol did not appear in court for Ms. Ruiz’s hearing earlier this week. That led to an automatic dismissal of the citations, but doesn’t shield Ms. Ruiz from potential civil liability. No suits had been filed as of Friday, April 12, 2024.
Video shows that Ms. Ruiz swerved into the oncoming lane of traffic, causing the crash. But law enforcement sources suggest that prosecuting anyone suffering a medical emergency, and who reasonably had no expectation that a herd of bicyclists would be on the road in the pre-dawn hours — would have been an extreme challenge.
Thank you for the follow-up article.
I hope the cyclists that were injured all have excellent health insurance and are doing well in whatever rehab and therapy they need to fully recover.
I also hope that the FHP officer is cited for dereliction of duty and contempt for failure to appear in court.
“unknowingly operating a vehicle while license suspended or revoked“
What does this mean? Even if she had a “medical emergency” while driving, how does someone “unknowingly” operate a vehicle? Was she sleepwalking?
Re-read it. It’s the statute. Unknowingly operating a motor vehicle WITH A SUSPENDED LICENSE.
