BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — The Bocaire Country Club is facing a major lawsuit just filed in Palm Beach County Circuit Court by an attorney who says the country club’s security force prohibited him, his wife, and his children from seeing his elderly mother.

Philip Sporn claims that his mother, Enid Michaelson, is 92, “mentally incompetent or incapacitated,” and has lived in Bocaire for approximately 33 years. While Mr. Sporn, his wife, and his children have visited Enid on an almost daily basis to bring food and companionship, Bocaire inexplicably stopped letting the family into the community during part of February, 2024.

The following is from the complaint obtained by BocaNewsNow.com, and focuses on a part of the lawsuit that explains what happened after Ms. Michaelson’s family was apparently denied entry into Bocaire.

“During the aforementioned, ENID MICHAELSON personally called Defendant, BOCAIRE COUNTRY CLUB, INC., and its guard house, demanding and pleading that her son, Plaintiff, PHILIP J. SPORN, his wife, HILLARY SPORN, and their three children be permitted to visit her, bring her lunch and dinner.

These demands were witnessed by Plaintiff, ENID MICHAELSON’s caretakers and were made on each occasion Plaintiff, PHILIP J. SPORN attempted to gain access to his mother, Plaintiff, ENID MICHAELSON. Despite Plaintiff, ENID MICHAELSON’s clear and express continuing demands and pleas, Defendant, BOCAIRE COUNTRY CLUB, INC., denied PHILIP J. SPORN, his wife, HILLARY SPORN, and their three children access to his mother, causing severe emotional distress to both Plaintiffs.

As a result of being prevented from seeing her son, daughter-in-law, and grandchildren, Plaintiff, ENID MICHAELSON, who is 92 years old, on several occasions, did in fact, attempt to walk and had to be restrained from walking approximately one-half (1/2) miles to the guard house to see her family and attempt to secure Plaintiff, PHILIP J. SPORN’s entry, putting herself at risk of physical injury.”

The lawsuit accuses Bocaire Country Club of Violation of Enid Michaelson’s rights as a resident, False Imprisonment, Intentional Infliction of Emotional Distress, Breach of Contract, Negligence, Elder Abuse, Negligent Infliction of Emotional Distress.   1. The country club only bars visitors from entering the facility when one violates the rules such as excessively speeding multiple times through the community and ignoring stop signs. When guests or contractors of residents continue to violate the rules of the community – you get blocked, pretty plain and simple. Maybe this nudnick should realize that instead of suing. This case will be thrown out.

    1. After reading this interesting complaint against Bocaire Country Club, it can only be an employee who would call the Plaintiff a nudnick! After reading both the newspaper and then the complaint, this person only can focus on speeding vs. the story within the compelling newsworthy complaint.
      Bocaire seems to have spent a whopping $10 million to entice younger families to the community so they certainly do not need bad press!
      This case will absolutely go all the way to a jury trial and I hope the country club and its members pay the price for having despicable employees.

      No entire family should ever be prevented from seeing their elderly mother. Shame on Bocaire Country Club!
