BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — The Encore at Boca Raton, a nursing and rehabilitation center, is facing a major lawsuit filed in Palm Beach County Circuit Court. The suit alleges gross negligence by employees who were so incompetent that they let a patient die.

According to the complaint obtained by BocaNewsNow.com, Alphonso Lee Davis was a resident of the Encore at Boca Raton with a known history of medical issues to be monitored and treated by employees. The employees, according to attorneys for the Davis family, failed. This is an excerpt from the suit:

“During ALPHONSO LEE DAVIS’ residency at The Encore at Boca Raton Rehabilitation and Nursing Center, LLC, the staff and employees failed to develop an adequate care plan and properly monitor and supervise the care and treatment provided to ALPHONSO LEE DAVIS in order to prevent him from suffering the development and deterioration of wounds; to prevent him from suffering falls and unexplained injuries; and, to prevent him from suffering the development and deterioration of respiratory failure.

As a direct result of THE ENCORE AT BOCA RATON REHABILITATION AND NURSING CENTER, LLC’s acts and omissions, ALPHONSO LEE DAVIS suffered the development and deterioration of wounds; suffered falls and unexplained injuries; and, suffered the development and deterioration of respiratory failure.”

The complaint also alleges that Encore is so poorly run, that managers and employees failed to institute even the most basic medical care. The following is a list of allegations made against Encore in the complaint:

“…failing to properly provide a turning program for the prevention of wounds; failing to provide a proper mattress, bedding, protective devices and positioning devices for ALPHONSO LEE DAVIS; failing to turn and position ALPHONSO LEE DAVIS timely and appropriately to prevent wounds; failing to properly recognize the development and deterioration of pressure sores on ALPHONSO LEE DAVIS and failing to obtain treatment to prevent the worsening of such wounds; failing to adequately clean ALPHONSO LEE DAVIS to prevent skin breakdown due to continual contact with feces and urine; failing to provide and implement appropriate fall precautions to ALPHONSO LEE DAVIS; failing to provide appropriate fall supervision to ALPHONSO LEE DAVIS; failing to provide ALPHONSO LEE DAVIS with appropriate care, treatment and supervision to prevent him from suffering falls; failing to prevent ALPHONSO LEE DAVIS from suffering unexplained injuries; failure to properly supervise ALPHONSO LEE DAVIS; failing to provide adequate and appropriate protective and support services to ALPHONSO LEE DAVIS; failing to develop, implement, and update an adequate and appropriate resident care plans to meet the custodial needs of ALPHONSO LEE DAVIS.”

The suit seeks in excess of the statutory minimum of $50,000. The Encore at Boca Raton had not filed a response to the suit — processed by the Palm Beach County Clerk of Courts — as of early Friday morning.

  1. Omg that is why I took my mom out of Encore she kept getting UTI and I had to hire someone 7 days a week and still have to go there to help her. This place is horrible and it smells like urine when you go upstairs where residents live. They make it look clean downstairs. I was constantly calling complaining. I had a detail list that I kept since I was going to also sue them for negligence .

  2. I was there for 5 weeks in 2022. Rehab after back surgery. Understaffed like most care homes. Never saw the second floor where residents stayed.

  3. This place should be condemned along with the kind of staff they have there
    My mother was there for rehabilitation.
    They don’t care about the patients in there. If they got her out of bed they would leave her to sit in the hallway hours at a time!!
    You can be standing at the nurses station to plead for something and no one even looks up. Why would these staff people want to treat our family like they are worthless? No dignity at all. My mom’s personal items were stolen while there. I even called for a meeting with their head nurse about how negligent they were with her care. I wouldn’t bring a dog there to have anyone to care for it.
    INVESTIGATE THIS FACILITY AND SHUT IT DOWN!!

  4. Several years ago my Dad was victim of incompetent staff. He developed cellulitis and needed to be transferred to hospital – staff failed to inform hospital on transfer papers that my Dad was on pureed diet, not regular food due to swallowing issues. I caught it only after hospital gave him solid food. I reprimanded the director of nursing.

  5. If nursing home operators ban their employees from having TikTok accounts, I’m sure half the workforce (and I use the term “work” in “workforce” lightly) will quit or be fired, and ninety-five percent of establishments will improve.
