Man Claims He Received Bill, Via Email, Overnight.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A Palm Beach County man is suing Dropbox (NASDAQ: DBX), claiming that the company sent him a bill — via email — overnight. According to the lawsuit just filed in Palm Beach County Circuit Court, that email violates Florida consumer protection laws.
Emir Yidiz, according to the complaint which we are publishing below, received emails from Dropbox seeking $19.99 at 10:46 p.m on August 2nd, 2022, and again at 10:37 p.m. on April 18, 2023. Keeping in mind that one can turn off their email alerts or just disregard until convenient, attorneys for Yidiz are seeking class action status. They believe there is a huge number of people who also received emails overnight from Dropbox.
“Upon information and belief, Defendant has sent thousands of electronic mail communications to Florida consumer between 9 p.m. and 8 a.m., whereby such electronic mail communication(s) violate 559.72(17). The members of the Class, therefore, are believed to be so numerous that joinder of all members is impracticable.
It was unclear how, exactly, Emir Yidiz was harmed by receiving email between the hours of 9 p.m. and 8 a.m. It’s also unclear if lawmakers ever intended email to be covered by a statute that may have been designed to prevent bill collectors from telephoning during nighttime hours. The suit seeks in excess of $50,000 — the statutory minimum for filing in Palm Beach County Circuit Court. Dropbox had not responded to the suit, through a filing processed by the Palm Beach County Clerk of Courts, as of late Thursday afternoon.
