Boca Raton Memory Care Facility Sued After Resident Is Critically Injured

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A resident of Sonata Senior Living at 9591 Yamato Road in Boca Raton was identified as a “fall risk” and someone with dementia. But that allegedly didn’t stop the nursing staff from neglecting her to the point where she fell, broke her leg, and separately developed a bed sore. Attorneys Robert Lieberman are now suing the facility in Palm Beach County Circuit Court.

BocaNewsNow.com obtained the complaint. Here are two highlights: “SONATA SENIOR LIVING nursing staff negligently failed to adequately and appropriately care for, observe, monitor, assess and/or reassess ROBERTA LIEBERMAN; SONATA SENIOR LIVING nursing staff negligently failed to provide, obtain, or otherwise advocate for ROBERTA LIEBERMAN to receive timely and appropriate care; Failing to implement adequate precautions, after having prior notice of a potential risk, to prevent a fall which caused harm; Failing to provide an environment that was free from physical abuse and neglect. But for the negligent nursing care by the Defendant, SONATA SENIOR LIVING, provided to ROBERTA LIEBERMAN, she would have not suffered a fall that caused a fracture of her right leg.

That as a result of the above-described actions and/or inactions of the Defendant, SONATA SENIOR LIVING, by and through its agents, servants and employees, Plaintiff, ROBERTA LIEBERMAN, has suffered serious bodily injury, resulting pain and suffering, disfigurement, mental anguish, loss of the capacity for enjoyment of life, the expense of hospitalization, medical and nursing care and treatment and aggravation of a previously existing condition. These losses are permanent and continuing and ROBERTA LIEBERMAN will continue to suffer these losses in the future.”

The complaint specifically lists a number of nurses and care workers as being responsible for Lieberman’s condition. They are not listed as defendants. The suit seeks in excess of $50,000 which is the statutory minimum for filing a complaint in Palm Beach County Circuit Court. Sonata is owned by Sonata Senior Living LLC and operates as Sonata Assisted Living Memory Care Boca Raton. Sonata had not filed a response to the suit, processed by the Palm Beach County Clerk of Courts, as of 5 p.m. Tuesday.
