Alleges Critical Injuries. Suing Management Company Responsible For Hotel In Boca Raton.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A woman claims she slipped and fell outside the Marriott Boca Center at 5150 Town Center Boulevard. She is now suing the management company — AVR Boca Center Hotel LLC, alleging the company knew its parking lot was in bad shape but did nothing about it.
Marcy Heuman claims that on May 11, 2024, she was “lawfully walking on the aforementioned parking lot towards her parked car, when she tripped and fell as a result of an unloved, broken, raised, and otherwise dangerous condition that existed on the subject parking lot. At the said time and place, Heuman was an invitee, lawfully upon the Premises of the Defendant, who owed Plaintiff a duty to exercise reasonable care for her safety.”
The suit states that AVR Boca Center Hotel, LLC, “had a non-delegable duty to Heuman, as its invitee, to provide a reasonably safe environment, including but not limited to maintaining the subject parking lot so that it was not uneven, raised, cracked, loose, did not have abrupt changes in elevation, and was not otherwise in a dangerous and defective condition.”
As a result of her fall, Heuman allegedly sustained “permanent bodily injuries in and about her body and extremities, including but not limited to pain and suffering of both a physical and mental nature, disability, disfigurement, permanent and significant scarring, mental anguish, loss of the capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment,” and more. She seeks in excess of the $50,000 statutory minimum for filing in Palm Beach County Circuit Court.
Heuman is represented by Morgan and Morgan. AVR Boca Center Hotel, LLC, had not filed a response to the suit as of Friday afternoon, July 5, 2024.
