BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — Two New Yorkers are suing Boca West Realty over what they claim is a fraudulent contract to buy a condo in the Boca Raton community of Boca West Country Club. At issue: the meaning of the term “As Is,” and whether or not “as is” includes anything done to the condo before purchase.

Gilbert and Linda Snyder claim in a complaint obtained by BocaNewsNow.com that they entered into an “as is” agreement to purchase 6875 Willow Wood Drive, Unit 2066, in Boca Raton back in 2020. The purchase price: $130,000 — a notably low cost for anything in Boca Raton. The closing date was set for May 27, 2020. The suit alleges that the sellers, identified as the Mitzner family, entered into a contract stating that “Seller does not know of any improvements made to the Property which were made without required permits or made pursuant to permits which have not been properly closed.”

But the Snyders allege this: “Despite the representation in the ‘As Is’ contract, the Snyders investigation revealed that the Mitzners had conducted extensive improvements to their condominium unit which require permits, which were not applied for nor obtained. The Mitzners have refused to authorize the return of the escrow despot, were complicit in the demise of the Plaintiffs not becoming members of the Boca West Country Club and instigated both the Ad Hoc Committee and the BWCC Board of Governors’ into investigating improper conduct by the Snyders on the failure to complete the closing of the ‘As Is’ contract between the parties.”

There’s more: “Furthermore, the Mitzners were complicit in persuading Boca West Country Club to deny the Snyders approval for club membership as part of the purchase requirements of another condominium at the Boca West Country Club which they were renting.”

The suit is actually against Boca West Realty, LLC — the agency representingthe Mitzners. The Real Estate Agent is identified in the lawsuit as Mallory McCabe. The complaint spans nearly 200 pages and is available to read — in its entirety — right here. Records obtained by the Palm Beach County Property Appraiser indicate the condo was purchased by someone else in August of 2020 for $120,000. We note that a civil complaint is claim made by one party against another to be settled in court.
