Files Foreclosure Lien Against Couple, Although One Member Is Deceased.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — In the latest reminder that fees and dues are not optional if you live (or lived) in a Florida community with an HOA, COA, POA, or other association, Century Village Boca Raton is suing a condominium owner and his deceased spouse. At issue — less than $5,000.
According to documents reviewed by BocaNewsNow.com, Abraham and Madalyn Frydman have not made full payment on several monthly assessments in the amount of $598.84 each. The total now owed: $4,498.73. Madalyn has a reason. She’s apparently dead — at least according to the complaint filed with the Palm Beach County Clerk of Courts. But Abraham is apparently alive. And, according to the suit, responsible for the unpaid money.
The foreclosure suit was just filed by “Rexford At Century Village Condominium Association, Inc.” which is the condo association that has jurisdiction over the unit in question. The language used is boilerplate, but stern: “Plaintiff requests that this Court enter judgment for its Claim of Lien, plus interest, plus all regular and special assessments, interest and late fees/administrative fees accruing from the date of the Claim of Lien due to the Plaintiff from AVRAHAM FRYDMAN, together with interest, late fees, reasonable attorney’s fees, costs, abstract expenses, and all other allowable costs and expenses; and additionally if such sums are not paid within the time set by this Court, that the Property be sold to satisfy the Plaintiff’s claim, and, additionally if the proceeds of the sale are insufficient to pay such claim, that a deficiency judgment be entered against AVRAHAM FRYDMAN, and that all persons claiming under or against AVRAHAM FRYDMAN, since the filing of the Notice of Lis Pendens be foreclosed, and that this Court grant such other and further relief as it may deem proper.”
Rexford at Century Village is represented by attorney Daniel Wasserstein of Wasserstein P.A. In Boca Raton. No counsel was listed for Mr. Frydman who also did not file a response to the suit. The complaint has been set for an expedited trial without a jury.
