Boynton Beach HOA On Receiving End Of Lawsuit Filed In Palm Beach County Circuit Court.

BOYNTON BEACH, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — Valencia Isles HOA is facing a major lawsuit just filed in Palm Beach County Circuit Court. According to the complaint obtained by BocaNewsNow.com, a woman who does not live in the community claims that she was invited into the clubhouse, only to fall and sustain critical injuries. She is now seeking in excess of $50,000 — the statutory minimum for filing in Palm Beach County Circuit Court.
The complaint alleges that Francine Dorman, who we note lives in an $85,000 condo between Jog and Linton in Boynton, “was an invitee in the Defendant’s clubhouse on the premises located at 11200 Valencia Isles Boulevard in Boynton Beach. While walking on the premises, Francine Dorman tripped and fell on an uneven, dangerously sloped, unmaintained portion of the sidewalk along the clubhouse walkway on the premises. Defendant, Valencia Isles Homeowners Association, Inc., did not have warning signs, lights, and/or warning cones placed around the uneven, dangerously sloped, unmaintained sidewalk to warn of the hazardous condition.”
The suit adds: “As a direct result of Defendant, Valencia Isles Homeowners Association, Inc., failure to safely maintain the sidewalk along the clubhouse walkway, Plaintiff Francine Dorman fell and suffered severe injuries.” Among the injuries: “bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expenses of hospitalization, medical and nursing care and treatment, and aggravation or acceleration of preexisting injury.”
Dorman is represented by Judd G. Rosen of Goldberg and Rosen in Miami. The Valencia Isles HOA had not filed a response to the suit processed by the Palm Beach County Clerk of Courts as of mid-day Monday. Valencia Isles is located at near Hagen Ranch Road and West Woolbright Road in unincorporated Boynton Beach.
