
BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A Boca Raton woman is suing Publix after she allegedly slipped and fell in their store at 7060 West Palmetto Park Road. Cari Rosenthal claims that Publix should have known there was some sort of liquid on the floor, somewhere in the store, and that the liquid would change her life forever. Here are key excerpts from the complain obtained by BocaNewsNow.com and filed in Palm Beach County Circuit Court where the statutory minimum demand is $50,000:
“On or about May 17, 2024, the Plaintiff, Cari Rosenthal, was lawfully on the premises of the Defendant, Publix Super Markets, Inc., located at 7060 W. Palmetto Park Road, Boca Raton, FL 33433, as a business invitee. That on or about May 17, 2024, the Defendant, Publix Super Markets, Inc., by and through its agents, employees, and/or servants, had exclusive dominion, possession and control of the premises. That on or about May 17, 2024, the Defendant, Publix Super Markets, Inc., by and through its agents, employees, and/or servants, negligently and carelessly maintained the above mentioned premises, to-wit; allowing a liquid to remain in the area.
That the Defendant, Publix Super Markets, Inc., either knew or should have known of the existence of the dangerous condition of the common area where patrons traverse and should have taken steps to warn the Plaintiff, Cari Rosenthal, of the existence of the dangerous condition. That the Defendant, Publix Super Markets, Inc., had a duty to maintain the common areas where patrons traverse in a reasonably safe and proper condition for the general public. That the Defendant failed to maintain said common areas in a safe and proper condition by allowing a liquid to remain in the area where patrons are expected to traverse. That the Defendant, Publix Super Markets, Inc., was negligent in creating or permitting the aforementioned dangerous and hazardous condition to remain upon the premises, rendering said premises dangerous and unsafe for the Plaintiff.
As a direct and proximate result of the negligence of the Defendant, Publix Super Markets, Inc., the Plaintiff, Cari Rosenthal, suffered bodily injury and resulting pain and suffering, permanent disability and/or permanent impairment, permanent scarring, aggravation of pre-existing condition, loss of the capacity for the enjoyment of life, inconvenience, lost wages and loss of ability to earn money in the past and in the future; all of which are permanent and continuing in nature.”
Rosenthal is represented by Attorney Leslie Duberstein Glenn of Boca Raton. Publix has not yet filed a response to the suit processed by the Palm Beach County Clerk of Courts.
