LAWSUIT CLAIM: Delray Nursing Home So Bad, Patient Dies From Poor Care

A local nursing home is facing a lawsuit over a claim that horrible conditions and care led to a patient’s death.

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — West Delray Nursing and Rehab Center is facing a lawsuit from a family that claims its loved one was provided such horrible care that the skin on her face tore. The injuries she allegedly sustained were so horrific that she died just months after entering the facility.

The family of Florence Demain just filed suit in Palm Beach County Circuit Court. Here are highlights from the complaint which officially names “West Delray OPCO LLC d/b/a West Delray Nursing and Rehab Center and Palm Beach Health Consulting, LLC” as defendants.

“On November 11, 2023, DEMAIN was admitted to WEST DELRAY NURSING for rehabilitation services. Upon admission, it was noted that DEMAIN was a fall risk, had skin integrity issues, specifically redness to her sacrum, and bruising to her bilateral antecubitals. WEST DELRAY NURSING provided a baseline care plan with minimal interventions. On November 25, 2023, DEMAIN was noted to have a skin tear on her face. No additional information was provided. Emergency Medical Services were not provided.

DEMAIN was also noted to have a sacral pressure ulcer on her backside and a deep tissue injury to her right heel. Neither additional information nor Emergency medical services were provided. On December 6, 2023, it was noted that DEMAIN’s health was declining, as she required IV fluids for hydration, due to her lack of appetite. Furthermore, orders were received to cancel her physical therapy and occupational therapy services.

On December 23, 2023, DEMAIN appeared with an injury to her genital area. It was noted she was receiving oral antibiotics for same. Neither additional information nor emergency medical services were provided. Following same, DEMAIN appeared with bruising around her shoulder and neck area. There was no further information provided.

DEMAIN passed away on December 27, 2023. Prior to admission to WEST DELRAY NURSING, DEMAIN did not have any bruising, sacral pressure ulcer, or deep tissue injury. As of at least November 11, 2023, WEST DELRAY NURSING had knowledge of DEMAIN’s prior medical conditions as well as her skin interitv iccues snecifically the redness to her sacrum.

Between DEMAIN’s date of admission on November 11, 2023 and DEMAIN’s date of death, December 27, 2023, Demain’s injuries only worsened. Between DEMAIN’S date of admission on November 11, 2023 and DEMAIN’s date of death, December 27, 2023, DEMAIN appeared with new injuries to her body. As a direct and proximate cause of Defendant’s acts, omissions and violations of Florida Statute, Demain suffered bodily injury and resulting pain and suffering, disability, mental anguish, loss of capacity, and for the enjoyment of life and untimely death.”

The suit seeks in excess of $50,000 which is the statutory minimum for filing a claim in Palm Beach County Circuit Court. The Demain family is represented by Mariela Cano, Esq., of “Your Insurance Attorney, PLLC” in Coconut Grove.
