Lawsuit Filed Against Driver By Victim Prior To Death…

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — An 83-year-old Boynton Beach man is dead after being struck on Jog Road by an 83-year-old driver, according to the Palm Beach County Sheriff’s Office. Stanley Toback of Imperial Isles Drive died on Saturday — nearly three months after the crash on November 5th. He had been hospitalized since the crash.
Police say Toback was a passenger in a 2025 Toyota Camry driving northbound on Jog Road, just north of Lake Ida Road. That’s when a 2024 Lexus ES350, driven by Richard Schlesinger, was heading southbound. Schlesinger, according to police, turned left into the plaza — “violating the Camry’s right of way by traveling directly into its path.”
The crash occurred when the right side of the Lexus ES350 impacted the front of the Toyota Camry. Stanley Toback, pulled from the Toyota, was rushed to Delray Medical Center where he remained in critical condition until his death at 10:38 a.m. Saturday. Richard James Schlesinger of Coral Lakes Drive in Boynton, the driver of the Lexus, was not injured.
The investigation continues Monday. No charges have been filed. The crash took place at 11:33 in the morning. The shopping center in the area includes a pain management clinic, a dental office, and a Publix which appears to share the same driveway. We note that a lawsuit was filed several weeks after the crash against Richard Schlesinger by an attorney representing Stanley Toback. At the time of filing, the attorney wrote: “As a direct and proximate result of the negligence of the Defendant, RICHARD, JAMES SCHLESINGER, Plaintiff, STANLEY TOBACK, suffered bodily injury resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expenses of hospitalization, medical and nursing care and treatment, and aggravation of a previously existing condition. These losses are either permanent or continuing in nature and Plaintiff will continue to suffer these losses in the future.”
