BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — Air Recuse Service “Med Jets,” based in Palm Beach County, is facing a wrongful death lawsuit after a crash and explosion that left four people dead. The lawsuit was just filed in Palm Beach County Circuit Court. The complete complaint is published at the end of this article.

The suit is filed on behalf of the family of victim Gerardo Alvarez Diaz who was the pilot of the doomed flight from Toluca-Licenciado Adolfo Lopez Mateo International Airport in Mexico and bound for Cuernavaca Airport which is roughly 60 miles away. He lived in Palm Beach County. The emergency transport flight included a co-pilot, a flight medic, and the patient. Everyone died when the plane landed, couldn’t stop, crashed and exploded into a fireball.

The plane, a LearJet 35A, was owned and operated by “Jet Rescue Air Ambulance” which is a Florida company operating under the name Med Jets. It lists a Glades Road office as its registered address, however, the address is actually a private post office box service that is used to collect and forward mail.

This is a key section of the complaint: “Defendant JET RESCUE had a duty to act reasonably and use due care in the maintenance and airworthiness of the Subject Plane, Defendant JET RESCUE had a duty to perform regular and routine maintenance of all plane systems including the braking and landing systems in accordance with all manuals, directives, safety bulletins, and maintenance instructions from the manufacturer. Defendant JET RESCUE further had a duty to ensure the airworthiness of the aircraft for all occupants, which included the braking and landing systems of the Subject Plane. Defendant JET RESCUE breached these duties when it recklessly failed to maintain or ensure the proper maintenance of the braking system and/or landing system for the Subject Plane. Defendant JET RESCUE’s lack of maintenance was “100% reckless” because an aircraft which is unable to land properly due to a failure in the braking or landing systems will certainly crash. Defendant JET RESCUE “exhibited an indifference to the life and safety” of any person who flew in that aircraft by its failure to properly maintain the Subject Plane and ensure its airworthiness for all occupants. As a direct and proximate result of the gross negligence of Defendant JET RESCUE, GERARDO ALVAREZ DIAZ died when the Subject Plane crashed and erupted into flames.”

The Diaz family is represented by Sagi Shaked, Esq., of the Shaked Law Firm in Miami. And the law firm of Webster Vicknair Macleod of Houston, TX. No attorney was listed for Med Jets USA, Inc, as of Saturday February 8th, 2025. Read the complete lawsuit, below.
