Allegation Made In Lawsuit Just Filed Against Terrace Of Delray Beach On Linton Blvd.

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — The family of a woman who allegedly choked on chicken and died in an area nursing home is now suing the facility over the death. Gail Stephany Greenbaum was a resident of the Terrace at Delray located at 5430 Linton Boulevard. According to the complain obtained by BocaNewsNow.com, she was suffering from multiple issues when she was given a chicken lunch. While staffers were allegedly paying no attention to Greenbaum, she choked on the chicken and died. The lawsuit, just filed in Palm Beach County Circuit Court, seeks in excess of the statutory minimum of $50,000. Here what an attorney alleges in the suit:
“At all times material hereto, the Decedent (82 at the time of death), was a full-time resident of Defendant, TERRACE OF DELRAY BEACH, LLC, and under its complete care and supervision. At the time of her death, the Decedent was diagnosed with a variety of medical conditions including but not limited to: recent history of respiratory failure with hypoxia; gastro-esophageal reflux; dementia; recent history of stroke; pneumonia; coronary artery disease; and atrial fibrillation.
On December 31, 2022, the Decedent was provided lunch at the TERRACE OF DELRAY BEACH, LLC nursing facility by Defendant’s staff and was eating lunch when she choked on chicken. At all times material hereto, the Decedent was left unsupervised in an unsafe position while eating her lunch for an extended period of time. At all times material hereto, the Decedent was severely health-compromised and had diagnoses and clinical findings that placed her at a high risk of choking on her food without proper assistance, supervision, and care. Due to Defendant’s failure to properly implement and/or follow an appropriate care plan for the Decedent’s then current needs and to properly supervise her while eating chicken, she choked and died.”
The suit claims that staff at The Terrace of Delray Beach failed to provide appropriate dietary accommodations, failed to provide supervision during meals, failed to position her properly during meals, and failed to properly respond to to the choking incident. The suit is filed on behalf of her surviving spouse and Ms. Greenbaum’s estate. Plaintiffs are represented by Attorney Joseph Stallone of Deerfield Beach. Terrace of Delray Beach, LLC, had not responded to the suit through a filing processed by the Palm Beach County Clerk of Courts as of Saturday, February 22, 2025.
