Jerry Newton, 66, was arrested by the Boca Raton Police Department early Wednesday morning after an officer allegedly spotted him swerving and running a red light. Police say Newton later provided two breath samples registering 0.151 and 0.146, nearly double Florida’s 0.08 legal limit.
The incident began just before midnight on October 22, 2025, when an officer traveling east on W Palmetto Park Rd observed a grey Hyundai Elantra swerving in and out of its lane. According to the arrest report, as the vehicle approached the intersection with the I-95 southbound ramps, it “failed to stop and continued straight through the red light.” The officer activated emergency lights, and the driver, later identified as Newton, pulled into the TD Bank parking lot at 1400 W Palmetto Park Rd.

Upon making contact, the officer reported smelling “a strong odor of an unknown alcoholic beverage” on Newton’s breath. When asked where he was headed, Newton allegedly stated he “was on his way to Flanigan’s to get a cheesesteak.” The report says Newton admitted to drinking “a couple of beers,” specifying he had “two Heinekens.” Newton agreed to perform Standardized Field Sobriety Exercises, which police say he failed, showing multiple signs of impairment including swaying, using his arms for balance, and being unable to follow instructions.
Newton was arrested for Driving Under the Influence. At the police station, he agreed to a breath test, which yielded the 0.151 and 0.146 results. After being read his Miranda rights, Newton reportedly admitted he was driving, stating, “Obviously,” and revised his earlier statement to “Obviously, two beers, maybe three.” Newton was transported to the Palm Beach County Jail and was later released on a $1,000 bond.
