Johanne Miucci Vachon, a former board president, and Eliza Ghazarian, a volunteer committee member, allege that Director Cristian Condurache orchestrated a smear campaign through community-wide emails that accused them of lying to police, theft, and covering up violent behavior.
The complaint centers on a series of heated emails sent by Condurache in late 2023 following a confrontation at an Infrastructure Committee meeting. According to the lawsuit, Condurache blasted the community with claims that Vachon and Ghazarian lied to Boca Raton police officers to protect a resident who had allegedly verbally assaulted another owner during the dispute. The plaintiffs assert these statements were knowingly false and designed to expose them to hatred, distrust, and ridicule among their neighbors.
Beyond the police incident, the lawsuit alleges Condurache publicly accused Vachon of misappropriating association assets—specifically a computer that the plaintiffs claim was actually in the management office’s possession the entire time. Condurache is also accused of targeting Ghazarian by claiming she stole an irrigation map. In what the complaint describes as an act of malice, the Association allegedly issued a “false” $300 invoice to Ghazarian for the map, a charge the suit claims was fabricated to punish her before ultimately being canceled.
The plaintiffs argue that these actions were part of a broader effort to disparage them, citing emails where Condurache urged residents to recall Vachon for “excessive unjustified spending” and “serious violations of the Code of Conduct.” Ghazarian’s filing includes a specific count for breach of fiduciary duty, arguing that the board and Condurache violated their legal obligations by manufacturing false debts and failing to adhere to association bylaws regarding financial assessments.
Vachon and Ghazarian are seeking damages in excess of the court’s jurisdictional limits, along with attorney’s fees and court costs. The complaint, filed in the 15th Judicial Circuit Court for Palm Beach County, demands a jury trial and reserves the right to seek punitive damages, contending that the defendants’ actions went beyond simple negligence and entered the realm of intentional malice against fellow homeowners.
