BURNED AT A BAR: Woman Sues After Alleged Sparkler Disaster in Delray Beach

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — A Palm Beach County woman is suing a Delray Beach bar and restaurant after she says she was burned during a bottle-service presentation that involved a lit sparkler moving through a crowded area, according to a newly filed civil complaint in circuit court.

The lawsuit, filed by Nicole Bernier and reviewed by BocaNewsNow.com, says the incident happened at Throw Social Delray Beach. The bar, located at 29 SE 2nd Avenue in Delray Beach, is named as the defendant. The alleged incident happened in March of 2024. Bernier says she was a customer at Throw Social when a bottle-service bartender carrying a lit sparkler walked through the crowd and burned her on the back of her arm, causing “significant and permanent injuries.”

In the filing, Bernier alleges the business had a duty to keep the premises reasonably safe, properly supervise and control bottle-service operations involving sparklers, and warn patrons about dangers that might not be obvious. The complaint alleges the defendant failed to put adequate safety policies and procedures in place for handling lit sparklers, failed to enforce any internal rules that did exist, and failed to properly train or supervise employees working in crowded patron areas.

Bernier is seeking damages in excess of $100,000. Attorneys representing her write that her injuries include burns, scarring, disfigurement, pain and suffering, emotional trauma, and more.
