Boca Raton Law Firm Retained To Sue Amazon.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — A Palm Beach County family is suing Amazon and a Chinese manufacturer after a man died when he became entrapped in a portable bedrail purchased on the e-commerce giant’s platform. The lawsuit, just filed May in Palm Beach County Circuit Court and obtained by BocaNewsNow.com, claims Thomas Michael Millaway, Jr. asphyxiated and died on January 6, 2025, just two weeks after the bedrail was delivered to his door.
The complaint names Amazon.com, Inc., Amazon.com Services, LLC, and a Chinese seller identified as FOYA-HOUSE as defendants. The bedrail — a Panta adult portable bedrail — was purchased December 23, 2024, and was marketed on the site as an “Amazon’s Choice” product. The lawsuit alleges the bedrail violated mandatory federal safety standards that have been in effect since August 2023, lacked required warning labels, and was incompatible with the bed Millaway was using because its retention system could not be permanently secured.
The suit, brought by Matthew Millaway as personal representative of his dad’s estate, argues that Amazon functioned as more than a marketplace — controlling storage, fulfillment, pricing, payment processing, customer service, and even recalls for products sold through its Fulfillment by Amazon program. Attorneys for the family say Amazon was in the best position to catch the dangerous product before it reached consumers, yet failed to properly vet FOYA-HOUSE or its products. The complaint also notes Amazon has declined to provide a verified address for the Chinese seller, offering only an email address.
The case, filed by Boca Raton law firm Gold & Gold, P.A., brings counts of negligence and strict liability against all defendants. Surviving spouse Kathleen Millaway is seeking damages for loss of support, companionship, and protection, as well as mental pain and suffering. The suit seeks in excess of of $50,000 — the statutory minimum for filing in Palm Beach County Circuit Court.
