DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — The family of a Delray Beach woman is suing Delray Medical Center, claiming neglect led to severe pressure wounds that contributed to her death. Jeffrey Layton, acting as personal representative of the estate of his mother, Marilyn Layton, just filed the lawsuit in Palm Beach County Circuit Court, accusing the hospital’s staff of failing to protect his mother from bedsores she should never have developed.
According to the complaint obtained by BocaNewsNow.com and published below, Marilyn Layton was admitted to Delray Medical Center in September 2025 with no skin breakdown at all. But as her condition worsened, she became unable to reposition herself in bed or in a chair without help from staff. The lawsuit alleges that hospital employees failed to identify her risk for skin breakdown, failed to put an adequate care plan in place, and failed to regularly reposition her or relieve pressure — allowing wounds to form and, later, become infected.
Layton’s attorneys argue the hospital and its staff, including nurses, CNAs, aides and wound care team members, did not meet the accepted standard of care. The suit says the resulting wounds required extensive treatment and caused Marilyn Layton additional pain in the weeks before she died on October 19, 2025. The complaint seeks damages for wrongful death. It cites medical bills, funeral expenses, and the loss of Layton’s companionship, comfort and support suffered by her survivors.
The case, filed by attorney David J. Brevda of Senior Justice Law Firm in Boca Raton. Delray Medical Center has not yet filed a response to the lawsuit.
