BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — A 76-year-old fertility doctor is suing Boca Fertility IVF Center, claiming the practice pushed him out because of his age after years of steering new patients to younger physicians.
Dr. Moshe Peress just filed the lawsuit in Palm Beach County Circuit Court against Boca Fertility, Inc., alleging violations of the Florida Civil Rights Act and the federal Age Discrimination in Employment Act. Peress served as the clinic’s Medical Director starting in January 2023, earning $500,000 a year. According to the complaint, front office staff were instructed not to book new patients with him starting in 2024, reserving his schedule mostly for returning patients while younger doctors took the new business. Clinic owners allegedly told Peress during a December 2024 “transition strategy” meeting that the practice would be more attractive to buyers if younger physicians made up the staff.
The lawsuit, obtained by BocaNewsNow.com, says Peress was later offered a new contract slashing his salary from $500,000 to $150,000 and cutting his hours to about 15 a week. He would also have needed sign-off from two younger, less experienced physicians before treating his own patients, the complaint states. Peress says he never agreed to retire and has documents showing the clinic told other doctors he had, even as it moved to replace him. His employment ended in January, following an October 2025 termination notice.
Peress claims his performance was never in question. He points to his ongoing role as an Associate Professor at Florida Atlantic University, where he continued mentoring medical students through December 2025 with strong evaluation scores. The lawsuit seeks back pay, front pay, compensatory and liquidated damages, reinstatement, and attorney’s fees.
