NOT OPTIONAL: Boca Pointe Sues Homeowner Over $5,000 In Unpaid Fees, Dues

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — A Boca Pointe homeowner is facing a lawsuit from the Palms At Boca Pointe Homeowners Association claiming that mandatory fees and dues have been unpaid for several months.

Atul Pachori of Travlers Tree Drive allegedly owed $5838.79 as of the time attorneys issued a written warning that non-payment would lead to a the community’s effort to secure a lien of foreclosure. That letter, according to court records reviewed by BocaNewsNow.com, was sent in June. A lawsuit was filed within the past few days when payment was apparently not received.

According to the court filing, Pachori’s past-due balance includes three quarterly assessments at $1699.24 each, 18-percent interest, attorney’s fees, costs for recording a claim of lien, and postage. The filing does note that a payment of $700 was received during the month of February.

Homeowners living in communities with homeowner associations, property owner associations, condo owner associations, or similar are required to sign documents acknowledging that fees are mandatory when a home is purchased. HOA’s and similar governing associations in Florida traditionally have the right to initiate foreclosure action on homeowners who do not pay these fees.

The official plaintiff and defendant for this case: “The Palms At Boca Pointe Homeowners Association, Inc., v. Atul Pachori individually and as trustee of the Atul Pachori Irrevocable Trust U/A Dated June 10, 2026, unknown tenant in possession #1, unknown tenant in possession #2.”
