BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — A Boca Raton nursing home let a bedbound, oxygen-dependent woman languish for years without basic fall protection, then failed her again when she hit the floor and broke her hip, according to a wrongful death lawsuit filed this week in Palm Beach County.
Agatha Marie Caputo, 90, spent nearly six years at Yamato Nursing & Rehabilitation Center on NW 51st Street, unable to move herself in bed or get up without help. The suit says staff never installed bed rails, alarms or other safety measures despite knowing she was a serious fall risk — and that she’d already hit the floor once in July 2024 without anyone documenting it.
The second fall came on October 5, 2024. Around 12:30 p.m., when staff allegedly heard a scream and found Caputo on her bedroom floor, screaming in pain and rating it a 10 out of 10. She’d fractured her hip. Boca Raton Fire Rescue rushed her to Boca Raton Regional Hospital, where doctors confirmed the break — but her frail health ruled out surgery. She went back to the nursing home two days later on hospice care and spent the next 27 days in bed, in pain, growing unable to speak or swallow before she died on October 30, 2024.
The lawsuit, filed by her son Francis William Caputo through the West Palm Beach law firm GoldLaw, alleges chronic neglect well beyond the fatal fall. The complaint, published below, describes pressure ulcers at every stage — from Stage 1 through Stage 4 — persisting for years, along with necrotic tissue on her toes and heels by the time she died. One allegation focuses on Christmas Day 2023, when Caputo is said to have asked for help at 6 a.m. and wasn’t cleaned until 3:30 that afternoon, when her family arrived to find her soiled and humiliated.
Named as defendants are Boca Opco, LLC, which does business as Yamato Nursing & Rehabilitation Center, and Palm Beach. No response had been filed to the suit as of Thursday afternoon.
