DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — A 43-year-old Delray Beach man allegedly told police he’d had “a lot” to drink before his DUI arrest. Then he refused a breath test. Eric Benjamin Raskin now faces charges of driving under the influence, refusal to submit to a breath test and refusal to sign or accept a citation, according to a Delray Beach Police probable cause affidavit reviewed by BocaNewsNow.com.
The stop happened around 8:40 p.m. on Sept. 23 near Lowson Boulevard and South Congress Avenue. An officer pulled over Raskin’s gray BMW for driving at a high rate of speed and making an improper turn, police say, and the car struck a curb as it turned. After the initial stop, Raskin started driving again before stopping a second time. When the officer asked for his driver’s license, he handed over his wallet instead.
Once out of the car, Raskin allegedly stumbled toward a nearby fence and leaned on it, according to the affidavit. The arresting officer reported glossy, bloodshot eyes, swaying and slow, slurred speech. Raskin said he was coming from his girlfriend’s house in west Delray and heading to east Delray. Several times during the conversation, police say, he put his hands in position as if he expected to be handcuffed. He declined to perform field sobriety tasks.
At the Palm Beach County Breath Alcohol Testing Facility, Raskin was read Florida’s implied consent warning and refused the breath test, with the refusal logged at 10 p.m. He also declined to answer questions and refused to sign the DUI citation. He was booked into the Palm Beach County Jail, later released, and is due in court in October.
