HERIBERTO GARCIA IS 113th KINGS POINT RESIDENT ARREST SINCE 2023.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — A 58-year-old Delray Beach man found asleep behind the wheel of his Mercedes on an Interstate 95 exit ramp in Boca Raton blew more than three times Florida’s legal limit after his DUI arrest, according to the Florida Highway Patrol.
Heriberto Garcia — who lives in the Kings Point senior community in Delray Beach — was arrested Oct. 14 on the northbound I-95 exit ramp to Congress Avenue. He is the 113th Kings Point resident to be arrested since 2023.
Around 2:21 p.m., a caller reported a black Mercedes swerving all over the road with a driver who appeared to be asleep. The car eventually stopped in the inside turn lane of the ramp, blocking it. When a trooper pulled up at 2:45 p.m., Boca Raton Fire Rescue was already on scene and Garcia was still sitting in the driver’s seat.

The trooper wrote that Garcia’s speech was extremely slurred and unintelligible, his breath carried a strong odor of alcohol, and he nearly fell to the ground after getting out of the car. He told the trooper he hadn’t been drinking. A Boca Raton firefighter, however, told troopers Garcia had admitted to him that he had. Garcia couldn’t get into position for field sobriety exercises, repeatedly losing his balance and walking toward the trooper after being told not to. Asked the color of the trooper’s grey pen, he said white.
At the county’s Breath Alcohol Testing facility, Garcia agreed to a breath test and provided samples of .291 and .286. The legal limit in Florida is .08. Bond was set at $1,000, and he’s scheduled to appear in court Nov. 19.
Garcia is the 113th arrest of a Kings Point Delray Beach resident since 2023. BocaNewsNow.com’s unofficial count indicates more residents of Kings Point are arrested than residents of any other senior living community in South Palm Beach County. Garcia joins Kings Point residents charged with crimes including weapons offenses, assault, battery, DUI, child image offenses, drug offenses, and more. Read our Kings Point coverage here.
