BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — Way Beyond Bagels is facing a nearly $2M lawsuit over the location it operated — then closed — at 16850 Jog Road in Delray Beach. We reported on Way Beyond’s issues at the Jog Road location a few years back. Read that coverage here. There were biohazard, rat, and other problems — many of which Way Beyond blamed on the landlord.
But now the landlord, CL Shoppes At Addison Place, is suing Way Beyond owners Harvey Daniels and Mindy Hyman. CL Shoppes claims that Daniels and Hyman are responsible for unpaid rent and other expenses that remained after the Jog Road location was closed. The location at Clint Moore and U.S. 441 remains open.
From the complaint obtained by BocaNewsNow.com:
”Defendants Harvey Daniels and Mindy Hyman executed a Continuing Lease Guaranty (the “Guaranty”) in Landlord’s favor, whereby said Defendants guaranteed performance of all obligations under the lease. See Composite Exhibit “A”. As of this Complaint’s date, Guarantors have failed and refused to perform their obligations under the Guaranty. CL retained the law firm McDonald Hopkins, LLC to bring this action and agreed to pay a reasonable fee for its services. CL has also incurred costs in pursuit of this action. Pursuant to the Lease and Guaranty, CL is entitled to recover damages and reasonable attorney’s fees and costs.”
