Schuman Charged By Police With Theft And Battery In Child E-Bike Incident. State Attorney’s Office Says It Hasn’t Received Case From Cops…

UPDATE April 14, 2026 at 4:40 p.m. — Sources within the State Attorney’s Office tell BocaNewsNow.com that despite our information from law enforcement, their office has NOT received the case from the Palm Beach County Sheriff’s Office. PBSO, however, told BocaNewsNow.com earlier that the case was assigned to prosecutors days ago — as we reported. So what is the actual status of this case? Here’s what seems to be the situation: PBSO sent the case file to the State Attorney’s Office, but the State Attorney’s Office either hasn’t physically received it or had it logged it into their system as of 5 p.m. on Tuesday. Believe it or not, while your speeding ticket appears online within minutes in Palm Beach County, some case files are physically driven from police offices to the State Attorney’s Office. That is what officials Tuesday are blaming on the slowdown. We have updated our reporting from early Tuesday with information based on responses from the SAO and PBSO.

Despite PBSO telling BocaNewsNow.com that the agency charged Schuman with battery and theft, the office of State Attorney Alexcia Cox has yet to file any paperwork with the Palm Beach County Clerk of Courts receive the case. In a county where arrest reports are often filed within hours, and arrestees appear before a judge within a day, the more than ten day delay for two alleged crimes involving a child is notable.
BocaNewsNow.com learned that the case was assigned to an ASA nearly a week ago. But that ASA has yet to contact the parents of the child victim actually receive the case file. The ASA police say was assigned to the case did not respond to an email from BocaNewsNow.com seeking explanation or clarification. A spokesperson from Alexica Cox’s office said it had not received what we’ll call a “packet” of information from PBSO.
As we reported exclusively, Mitchell Schuman was given a “notice to appear” on a charge of simple battery following the incident in Lotus — a community of $1M+ homes — on Good Friday. However, detectives from the Palm Beach County Sheriff’s Office — initially unaware of video published by BocaNewsNow.com — later dropped the lesser charge and filed new charges against Schuman of battery and theft. Each charge carries a potential sentence of one year in jail.
Mitchell Schuman is accused of throwing a water bottle at a young child who he claimed was performing “wheelies” on an e-bike in the Lotus community. Schuman is then accused of taking the child’s phone — preventing him from calling his parents or police. BocaNewsNow.com routinely reports on people arrested for that act alone — it is illegal to deprive someone of their communication device in the State of Florida. Schuman, not a lawyer but a legal professional whose biography has been stripped from his New York law firm’s website, allegedly taunted this child before. The parents of the child victim say they are baffled that Schuman wasn’t handcuffed on the spot and that no one who works with victims has reached out from the State Attorney’s Office to check on their child’s well-being. (Again, the State Attorney’s Office Tuesday afternoon says it’s received nothing about the case).
Meantime, BocaNewsNow.com has learned that the investigation continues into the other adults seen on the video, especially those seen physically restraining the boy as he attempted to retrive his cell phone from Schuman.
