BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2021 MetroDesk Media, LLC) — The diagnosis for West Boca Medical Center is chronic litigation, as the Tenet Healthcare facility (NYSE: THC) is again finding itself on the receiving end of a lawsuit.
This time, a FedEx driver claims that he slipped and fell on a wet floor at the hospital while delivering a package as part of his daily route. The hospital, according to the suit, knew the floor was wet and did nothing to warn visitors that the area was dangerous.
The suit follows another suit where a grandmother — excited to see the delivery of her grandchild — was allegedly told to walk, in the dark, to another hospital entrance. That grandmother tripped and fell on a speed bump and was allegedly critically injured.
In this case, FedEx driver Keven Reyes alleges, “West Boca Medical Center was negligent in failing to place warning and or caution signs in the subject area, and/or failing to place a floor mat in the subject area to dry off wet shoes, and/or failing to use slip-resistant paint and/or coating on the concrete floor in the subject area, and/or failing to well-drain the subject area so as to not allow puddles or rainwater to collect and/or gather, and/or failing to dry the wet floor in the subject area, creating an unreasonable condition and hazard.”
As a result of the fall, Reyes alleges that he “suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expenses of hospitalization, medical and nursing care and treatment, loss of earnings, loss of ability to earn money, and/or aggravation of a previously-existing condition. The losses are either permanent or continuing, and Plaintiff will suffer the losses in the future.”
The lawsuit was filed in Palm Beach County Circuit Court where the statutory minimum for damages is $30,000. The incident occurred in the 2019.
There was no immediate response filed by West Boca Medical Center. The facility is also facing a botched birth lawsuit where a doctor was arrested, a lawsuit regarding allegedly incompetent nursing, and the earlier mentioned “grandmother” lawsuit.
