UPDATE: The plaintiff in this case reported to us on July 9, 2025 that Rack Electric “did the right thing” and replaced the generator. The suit is dropped.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — A man who says he spent more than $30,000 on a brand new Generac whole-home generator is suing Boca Raton-based Rack Electric for allegedly installing the generator incorrectly. Nearly a year after installation commenced, the Palm Beach County resident says Rack still can’t get it to work.

James Robo, in the complaint just filed in Palm Beach County Circuit Court, says he entered into a $30,245 contract with Rack Electric for the generator back in May of 2024. Since the contract with executed, Robo claims that neither Rack nor Generac have been able to get the 48KW generator to operate, and that Rack Electric generates excuses but little else. Robo seeks in excess of $50,000 — the statutory minimum for filing in Palm Beach County Circuit Court.

In complaint, which you can read in its entirety below, attorneys for Robo appear to use Rack’s own words against the company, as Rack acknowledges problem after problem and failed efforts to resolve the issues. Frustrated, Robo wrote this in a message to Rack documented in November — six months after installation commenced: “This generator has never worked from the beginning. Jamie came yesterday for the third time and it faulted 24 hours later. You all have done 12 or 13 service calls for this generator, and it is has never worked. It is a $31,000 paperweight.”

Making matters worse, Rack allegedly acknowledged that it had no idea how to solve the problems and turned to Generac which offered little in the way of a fix. Rack, according to the complaint, wrote this on January 2, 2025 — eight months after installation. “We are currently in direct communication with Generac, the manufacturer of the generator. We have compiled and sent them a detailed list of errors, faults, and diagnostics from our previous attempts to address the problem. Generac is now reviewing this information to determine the next steps necessary to resolve the issue. We will keep you updated as soon as we receive further guidance from Generac.”

Nearly a year after installation, the complaint states the generator still does not work. “The first-class generator remains in place and is non-functioning, and is a dangerous and faulty instrumentality with the potential to cause additional damages, including damage to property, leaving homeowner and his property unprotected and vulnerable.”

Rack Electric — which merged with One Stop Generator last year — had not responded to the suit through a document processed by the Palm Beach County Clerk of Courts as of April 8th. Read the complete lawsuit, below. Mr. Robo is represented by Attorney David Markarian of Jeck Harris in Juno Beach.
