West Boynton Beach 55+ Community Doesn’t Just Say “No” To Kids, It Sues Them…

BOYNTON BEACH, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — The HOA of 55+ “Valencia Isles” in Boynton Beach is suing a family that is caring for a 4-year-old child, saying that child can not live in the community because young people are not allowed to be there. The Valencia Isles Homeowners Association filed suit in Palm Beach County Circuit Court against Johanna Fonseca, her family, and the child.
The suit claims that Valencia Isles has tried multiple times to force Fonseca and the child out of the community, but that they won’t leave. Court records suggest that Ms. Fonseca may be in the midst of a family situation and sought refuge with loved ones in Valencia Isles. But the HOA apparently doesn’t care. It wants a judge to order the child’s removal.
BocaNewsNow.com obtained the complaint filed by the Valencia Isles HOA. Two key elements are published below. You can read the entire suit at the end of this article.
“After discovering that a child under the age of nineteen (19) was residing at The Lot, the ASSOCIATION issued multiple pre-suit demand letters to the OWNERS, advising that OCCUPANT’s continued residency violates the Declaration and demanding that alternative housing arrangements be made. The OWNERS failed and refused to respond adequately to the ASSOCIATION’S pre-suit demand letters OWNERS have allowed a child under the age of four (4) years old to permanently reside at The Lot. OCCUPANT has resided in The Lot more than sixty (60) calendar days per the 2025 calendar year. OWNERS have materially violated the foregoing provisions of the Declaration by: (1) allowing a child under the age of four (4) to reside on The Lot permanently. JOHANNA FONSECA has materially violated the foregoing provisions of the Declaration by: (1) occupying The Lot with her child who is under the age of four (4).
Plaintiff, VALENCIA ISLES HOMEOWNERS ASSOCIATION, INC., respectfully requests that this Court grant the following relief: A. Issue a temporary injunction against OWNERS, requiring OWNERS to comply with the Declaration by immediately removing the underage child and JOHANNA FONSECA from The Lot, and Order the child and JOHANNA FONSECA removed from The Lot forthwith; B. Issue a permanent injunction against OWNERS, requiring OWNERS to comply with the Declaration by immediately removing the underage child and JOHANNA FONSECA from The Lot, and Order the underaged child and JOHANNA FONSECA removed from The Lot forthwith; C. Determine that ASSOCIATION is the prevailing party in this matter; D. Grant ASSOCIATION its costs and reasonable attorneys’ fees pursuant to Section 720.303, Florida Statutes, and Article XIV, Section 3 of the Declaration; and E. Grant such other and further relief as this Court deems just and proper, either at law or in equity!”
The Valencia Isles HOA is represented by Attorney Lauren Schwartzfield of Kaye Bender Rembaum in Pompano Beach. It was not immediately clear who is representing Ms. Fonseca and her four year old. Read the complete complaint, below.
