DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — A 36-year-old Delray Beach woman is facing a felony battery charge after police say she kicked an officer while resisting arrest over an open container violation on West Atlantic Avenue. Amanda Rae Altschuler, of Pelican Pointe Drive, is at least the second person in South Palm Beach County charged with an open container violation in days. We previously reported on the arrest of a Public Relations executive in Boca Raton.
According to Delray Beach Police, an officer and a community service aide were on extra patrol near 725 W. Atlantic Ave. around 4:33 p.m. on July 8th when they saw Altschuler walk out of a store with a can of Natural Ice beer inside a paper bag and open it in plain view. The officer, suspecting the drink was alcoholic based on “training and experience,” watched her circle the business twice before stepping in to stop her. When she tried to walk away, the officer says he took the can from her and poured it out, then asked for her name. Altschuler responded, “for what?” and refused to identify herself, according to the report, even after being asked multiple times.
Police say the Altschuler then channeled Houdini. She was placed in handcuffs and made to sit on the curb. She allegedly slipped one hand free before officers got the cuffs back on, and continued refusing to identify herself. When officers tried to place her in the back of a patrol car, she allegedly refused to cooperate, then laid on her back, bent her knees and kicked the arresting officer in the chest and legs. The report states Altschuler slipped her handcuffs again during the ride to the police station, and once there, tried to break away and flee before being restrained and placed in tighter cuffs. Officers say she kicked the interior partition and doors of the patrol car during that struggle as well.
Altschuler was booked on the felony aggravated battery charge along with two misdemeanors, resisting an officer without violence and violating the city’s open container ordinance. She was released on $1250 bond. A court date is pending.
