BOYNTON BEACH, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — The Boca Raton woman charged with DUI and child neglect allegedly drove on a curb, defecated on herself, only had three functioning tires, yet had two toddlers in the vehicle the whole time. Shannon Ashe was allegedly found with a bottle of pills when police nabbed her in Boynton Beach.

We first reported on Ashe’s arrest — her second in weeks — on Thursday. We have now obtained the affidavit of probable cause from the Boynton Beach Police Department. We are publishing it, in its entirety, below. We remind our readers that an arrest report is an allegation made by police. The validity will be determined in a court of law.

POLICE AFFIDAVIT

On the above date and time, BBPD dispatched center received a 911 call in reference to a drunk driver. The caller, later identified as (redacted), advised that a Dodge RAM pickup truck bearing FL tag HMGN93 was eastbound on Boynton Beach Blvd, City of Boynton Beach, and believed the driver might be impaired. The caller advised that the vehicle mounted the sidewalk and almost stuck pedestrians. The caller advised that the vehicle was seen with a flat tire and parked in front of AMF Bowling at 1190 W Boynton Beach Blvd, City of Boynton Beach. I arrived in the area and observed the vehicle parked at the location provided by the driver. I approached the driver’s side of the vehicle and contacted the female driver, who was later identified via her license as Shannon Leah Ashe. Shannon was with both toddlers were in the back seat. I introduced myself and attempted to speak to Shannon.

However, she became uncooperative and refused to identify herself. Shannon was incoherent at times, with a dry mouth, droopy eyelids, and a flushed face. Based on my training and experience, I suspected Shannon to be under the influence of unknown substances. I explained to Shannon my lawful reason for making contact with her and asked her for her driver’s license several times, and she refused. Shannon then put the key in the ignition, started the vehicle, and attempted to shut the driver’s door, at which time she was detained. I asked Shannon if she was taking any alcohol, medication, or prescription medication, and she said no. I then made contact with the caller/witness, who provided the following statement: The witness stated that (they) followed Shannon’s vehicle for more than a mile until the vehicle was parked. The witness stated that (they) observed Shannon’s vehicle swerving and mounting the curb at least five times while traveling northbound on Congress Ave, between Woolbright Rd and Boynton Beach Bivd. The witnesses stated that, while on Congress Ave, Shannon almost hit a family with her vehicle after she mounted the curb; the family had to move out of the way to avoid being hit while they were walking on a sidewalk.

The witness stated that, after Shannon made a right turn to travel eastbound on Boynton Beach Bivd, her vehicle mounted the side walk and almost hit another pedestrian in the area. The witness identified Shannon as the driver. Shannon’s vehicle was observed to have damage to the right front tire and rims, consistent with a vehicle hitting a curb. I informed Shannon of the damage to her vehicle, and she was unaware or sensed that she was driving on three tires. While speaking with Shannon, Ofc Anderson, while standing near the driver’s side door, observed several blue pills along with an empty pill bottle in plain view on the floorboard. The Pill bottle was labeled “Alprazolam” With clear instructions “to not operate heavy machinery after consumption). Due to Shannon being handcuffed, I informed her of her Miranda Warnings. Post Miranda, 1 asked I informed her that officers located the pills inside her vehicle. Shannon denied taking any alcopal and other drugs. However, she did not even realize that she defecated herself.

Based on my investigation, Shannon was placed under arrest for driving under the influence of narcotics or controlled substances. Additionally, Shannon was arrested for Child neglect. Shannon was transported to the Boynton Beach Police Department, where I conducted a 20-minute observation from 20:32 hours to 20:52 hours. Once completed, Shannon was asked to provide a sample of her breath to determine the alcohol content, and she refused. Implied consent was given to Shannon, who stated she understood. Shannon was asked to provide a breath sample for a second time, and she refused.

Based on my suspicion that Shannon was under the influence of her prescription medications, I asked her to provide a urine sample, and she refused. I informed her of the implied consent a second time, and she refused. Refusal time was called at 20:56 hours. Q/As completed. SHANNON LEAH ASHE was charged with DUI according to FSS 316.193.1A. Shannon was also charged with two counts of Child neglect, according to FSS 827.03.3c, for operating her vehicle while under the influence of prescription medications and putting the lives and care of children at risk who were inside the vehicle. Shannon’s driving records revealed that her driver’s license was suspended as of 04/22/2024, with three prior convictions and the most recent being for refusal to provide breath, urine, or blood samples. Based on this, Shannon was charged with DWLS according to FSS 322.34.2c and Refusal to submit to a breath test according to FSS 316.1939 (1).
