BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — Boca Raton resident Richard Dorfman is facing a DUI negligent manslaughter charge after police say he drove his Tesla Model 3 — at more than 100 mph — into a motorcycle driven by Boca Raton resident Ingrid Noon. Noon, 39, was killed. Dorfman, according to police, was under the influence of alcohol and marijuana at the time of the crash on August 26, 2022 near the intersection of SW 18th Street and Boca Rio Road. It normally takes a year for a vehicular homicide to be fully investigated.

Dorfman, of Chula Vista Acres in Boca Raton, was booked into jail on Thursday. He was later released on $75,000 bond. The following is the official crash report obtained by BocaNewsNow.com:

POLICE NARRATIVE: Based on the available evidence, interviews, forensic analysis, reconstruction, and investigation, the following conclusions were made concerning this collision: Prior to the crash, Noon (D-2) and Dorman (D-1) are observed leaving the parking lot of the Brickyard at 7050 W Palmetto Park Road. They enter their vehicles, and exit the plaza onto southbound Powerline Road. They then make the westbound turn onto SW 18th Street.

Dorfman (D-1) was operating a 2020 Tesla Model 3, Bearing FL tag CAKA31, herein referred to as V-1, westbound within the outer through lane of SW 18th Street. Noon (D-2) was operating a 2018 Kawasaki Vulcan S Motorcycle, bearing FL tag of MPDM17, herein referred to as V-2, westbound within the outer lane of SW 18th Street, in front of V-1, and was approaching the intersection of Boca Rio Road, within a 45 mile per hour zone.

As V-2 was approaching the intersection, the light changed from green to yellow. Noon (D-2) began to slow, applying the brakes to V-2, for the upcoming red light. At that time, V-1 was under full 100% acceleration, closing the distance toward V-2, at an increasing speed of more than double the posted speed limit of 45 mph. Dorman (D-1) was driving 95 mph and accelerating to 104 mph (EDR and Tesla Data) prior to the collision.

Dorfman (D-1) failed to observe V-2 beginning to slow and also the changing green to yellow light. Dorman (D-1) applies the brakes to V-1 half a second (0.5) seconds prior to the crash algorithm being enabled on the EDR. The brakes were applied heavy enough to enable ABS at the same time. (EDR data) Noon (D-2), did not observe or to have the belief that Dorfman (D-1) WAS traveling in excess of 100 mph (more than double the posted speed limit of 45 miles per hour), toward her, not observing the changing light, and V-2’s illuminated brake light. Noon (D-2) observed the rapidly closing speed of V-1, and releases the brake lever of V-2, just prior to impact (brake light dims on video).

During the collision, V-1’s front end violently impacts the rear of V-2, propelling Noon (D-2) onto V-1, and causing the front end of V-2 to lift off the ground. The hood of V-1 then unlatches, and impacts the windshield, covering the camera of Dorfman (D-1) then steers V-1 to the right and slows V-1 to a stop, as the hood comes off. Noon (D-2) is observed tumbling along the road to her final rest.

V-2 is observed sliding across the road on its right side to its final rest on the west side of the intersection, near the median. Dorfman (D-1) them calls 9-1-1 to report the crash and summon aid. Dorfman (D-1) stated the wrong road when informing the dispatcher numerous times, even when the dispatcher informs Dorman (D-1) of the correct road. Dorman (D-1) stated that V-2 made a move in front of him, and he did not expect it. Dorfman (D-1) believes the other vehicle is a motorcycle, and she cut right in front of him going really fast. Dorfman (D-1) identifies himself as the only occupant of V-1, and no one else is around him.

Dorman (D-1) stated that he observes the deputy arriving on scene, walking toward him as he is seated in the vehicle. While dispatch is speaking with Dorfman (D-1), he is slurring his speech, and is giving confusing and contradicting statements. Noon (D-2) was transported from the scene to Delay Medical Center, where she died from the injuries sustained in the collision. Dorfman (D-1) was later transported by EMS to Boca Regional Medical Center. I received Noon (D-2’s death report from the Palm Beach County Medical Examiner, which listed her death as a result of multiple blunt force injuries, which were caused by this collision. Based on observations of Deputy Sheriff Eduardo Alves (#32404) who observed Dorfman (D-1) seated in V-1, Deputy Alves, Investigator E. K. White (#7209), and Investigator A. Tejeda (#31814) observations of Dorman (D-1) appearing under the influence with the odors of an unknown alcoholic beverage coming from his person and as he spoke it became stronger, his speech was slowed and slurred. Dorfman (D-1) was also uneasy on his feet with having glassy, watery, and bloodshot eyes.

Dorfman (D-1) was identified as the driver of V-1 by Deputy Sheriff Alves (including Dorman (D-1)’s 9-1-1 call). Dorfman (D-1) caused the collision between V-1 and V-2. This collision caused serious bodily injury (later death) to Noon (D-2). Due to the above circumstances, blood draws were conducted on Dorfman (D-1) from the hospital admission, statutory, and search warrant providing toxicology results of 0.211/0.210 (hospital admission), 0.170/0.169 at 4:41 a.m., and 0.143/0.141 at 6:12 a.m. These results are more than the legal limit of 0.080. The results also include Marijuana (THC) results with levels of 5.6 +/- 1.1 ng/mL for both statutory and search warrant blood draws, conducted more than an hour and a half apart. The impairment of alcohol is additive with the use of marijuana that was quantified in the blood results.

Due to the impairment of alcohol and marijuana that Dorfman (D-1) was experiencing, and the speeds Dorfman (D-1) was traveling, he would have had a greatly diminished reaction time to take evasive action upon his realization that V-2 was slowing in front of him for the traffic light. A post-collision mathematical reconstruction was completed, by utilizing a minimum speed formula for V-1 from the area of impact to stop, of 102 Miles per Hour (MPH) by utilizing the deceleration factor of V-1. V-2’s Speed was established at 54 MPH, from where it began to slide on the roadway until it came to a final rest. Refer to mathematical documents attached to this investigative report.

The reconstruction and mathematical findings supported the speeds listed in the ED and tesla data log. Therefore, it was determined that the actions of Dorfman (D-1) by recklessly driving V-1 at a high rate of speed, (over twice the posted speed limit of 45 mph), on a roadway that contained multiple side streets, and intersections, approaching a bridge to an overpass, and accelerating 95 mph to 104 mph. Then accelerating to 100% throttle, thus disabling the driving, and collision avoidance features of the Tesla Model 3 (V-1), before braking heavy to avoid a collision with V-2 (EDR and Tesla Data), while being impaired and under the influence of both alcohol and marijuana, were the causes of the subsequent collision.

These actions, caused only by Dorfman (D-1), resulted in the death of Noon (D-2). My mathematical reconstruction revealed a speed in excess of twice the posted speed limit of 45 miles per hour, before V-1 slowed to a stop from the point of impact. There were no recalls, roadway defects, or vehicle defects that would have contributed to the causation of the crash.
